Terms of Use & Community Rules

1. About these terms
These Terms of Use and Community Rules (the "Terms") govern your use of the Rally mobile app, website at www.rallyapp.uk and related services (together, the "Services"). Rally is operated by Calum Brendan Feenan, trading as Rally ("Rally", "we", "us" or "our").
By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

2. Eligibility and your account
- You must provide accurate account information and keep it up to date.
- You are responsible for activity on your account and for keeping your sign-in credentials secure.
- Rally is not directed at children under 13. Do not use the Services if you are under 13.
- Do not create an account for someone else, impersonate another person or use the Services for unlawful purposes.
- You may delete your account through the app. Our Privacy Policy explains the current scope and limitations of account deletion.
3. Rally pacts and user content
Rally lets users create, join and participate in accountability pacts. Pacts, goals, reminders, proof requirements and comments are created or chosen by users. You are responsible for deciding whether to join a pact and for your own actions, health and safety.
You retain ownership of the content you submit, including photos, videos, captions, comments, reactions and check-ins ("User Content"). You give Rally a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display and process User Content only as needed to operate, improve, secure and provide the Services.
You confirm that you have the rights needed to submit User Content and that it does not breach these Terms or another person's rights.
Content and location information may be visible to other signed-in Rally users, including users outside your pact. See our Privacy Policy for the current visibility rules.
4. Community Rules
Use Rally constructively and respectfully. You must not:
- post, request, encourage or share unlawful, harmful, threatening, hateful, harassing, discriminatory, abusive, sexually exploitative or otherwise objectionable content;
- bully, shame, intimidate, stalk, dox, threaten or target another person;
- post another person's private, sensitive or personal information without their permission, including their location, health data, images or contact details;
- post content that infringes intellectual-property, privacy, publicity or other rights;
- submit false, misleading or manipulated proof, impersonate another person, or manipulate pact activity or scores;
- use Rally to promote self-harm, dangerous challenges, illegal activity, scams, spam or unauthorised advertising;
- upload malware, interfere with the Services, scrape data, attempt unauthorised access or bypass security measures; or
- use the Services in a way that breaches applicable law or these Terms.
You can report suspected rule breaches through the app where reporting is available or by emailing support@rallyapp.uk with enough detail for us to investigate.
5. Moderation and enforcement
We may investigate reports and take action that we reasonably consider appropriate, including removing content, restricting features, suspending or terminating accounts, or reporting matters to relevant authorities. We are not required to monitor all content, and we cannot guarantee that every breach will be detected or removed immediately.
We may preserve information where reasonably necessary to investigate abuse, protect users, comply with law or enforce these Terms.
6. Health, fitness and safety
Rally is an accountability and community tool, not a medical, health, fitness, nutritional, legal, financial or mental-health service. Content created by users is their own and is not professional advice from Rally.
Consult a qualified professional before beginning or changing an exercise, health or nutrition programme. Stop activity and seek appropriate assistance if you feel unwell or unsafe. You participate in pacts and activities at your own risk.
7. Payments and paid pacts
Some payment-related functionality may be introduced in the future. If paid pacts or other paid features are made available, the applicable price, payment terms, consequences, refund information and any supplementary terms will be shown before you commit to payment. Payment processing may be provided by Stripe or another disclosed payment provider.
8. Our Services and intellectual property
We may change, suspend or discontinue any part of the Services where reasonably necessary, including for maintenance, security, legal or product reasons. We will try to give notice where practical, but cannot guarantee uninterrupted or error-free availability.
Rally, our branding, software and other material we provide are owned by or licensed to us. We grant you a limited, personal, non-transferable and revocable right to use the Services in accordance with these Terms. You may not copy, modify, reverse engineer, distribute or exploit them except where law permits it.
9. Liability
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for fraud or fraudulent misrepresentation, or for death or personal injury caused by negligence.
To the extent permitted by law, Rally is not responsible for user-generated content, interactions between users, outcomes of pacts, loss caused by a user's breach of these Terms, or indirect or consequential loss. Your statutory consumer rights are not affected.
10. Privacy
Our Privacy Policy explains how we collect, use, share and protect personal data. It forms part of these Terms.
11. Changes to these Terms
We may update these Terms from time to time. We will post the revised version at www.rallyapp.uk/terms, update the “Last updated” date and provide additional notice where changes are material or required by law. Continued use after the effective date means you accept the updated Terms.
12. Governing law and contact
These Terms and any dispute or claim arising from them are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except where applicable law requires otherwise.
